Culpable driving

This criminal offence covers homicides caused by the culpable driving of a motor vehicle. This offence is committed when a person drives a motor vehicle negligently, recklessly or while under the influence of drugs or alcohol and causes the death of another person.

'Imprisonment' above includes all sentences that have immediate custody as a component of the total sentence. This may include imprisonment combined with a community corrections order, a partially suspended sentence, or another custodial sentencing outcome.
